Which costs less: three example cases

SituationTrust & WillLegalZoom
Single, a will with powers of attorney and a health care directive$199$149 (Pro); cancel the $25-a-month attorney plan after 30 days if you don’t need it
Married couple, living trust, one home to move into it, no attorney$599 + $140 deed = $739$499 + $249 deed = $748
Married couple, living trust with a year of attorney access$599 + $299 = $898$649 (Premium)

Recording fees, and notarizing the deed, apply either way. On these numbers, LegalZoom costs less for a simple will and for a trust with attorney time, and the two are almost even for a couple’s trust with one home.

Documents included

Trust & Will

Will Plan: will, financial power of attorney, health care directive (living will and medical power of attorney), HIPAA authorization, guardians for children and pets.

Trust Plan: revocable living trust, pour-over will, the same powers of attorney, directive and HIPAA authorization, schedule of assets, certification of trust and a trust funding guide.

LegalZoom

Basic Will: will with pet care provisions. Pro and Premium: add a health care directive, medical and financial powers of attorney and a HIPAA authorization.

Living trust (both tiers): living trust, pour-over will, health care directive, financial power of attorney, HIPAA authorization, certificate of trust, schedule of assets and a bill of transfer.

On paper, the two trust packages are close. The bigger differences are attorney access, renewals and what each charges to move your home into the trust. Whichever you choose, the trust only avoids probate for assets you transfer into it; see how to fund a living trust.

Attorney help

LegalZoom builds attorney calls into its upper tiers: unlimited 30-minute consultations with a participating firm, one per new legal matter. The Pro will includes 30 days, then renews at $25 a month. Premium wills and trusts include a year, then $199 a year, plus an annual one-hour plan review and 25% off attorney services.

Trust & Will sells Attorney Support separately: $299 for a year of phone access to a licensed estate planning attorney, for questions about your plan, documents, taxes, beneficiaries, funding and signing. It is not offered in seven states. For complex plans, Trust & Will matches you with an attorney for free; that attorney sets the fee, and Trust & Will lists attorney plans from $1,499.

Neither company is a law firm, and neither service replaces an attorney who reviews your whole situation. See will vs living trust for when that matters.

Updates, refunds and renewals

  • Updates. Trust & Will’s optional $49-a-year membership covers editing your plan, according to its help center. LegalZoom includes 30 days of revisions on its Basic and Pro tiers and a year on Premium, and sells a separate revisions subscription.
  • Refunds. Trust & Will takes refund requests within 30 days of purchase; membership payments are final. LegalZoom refunds estate plans up to 7 days after the first document is completed, or within 60 days if the order is not completed.
  • Renewals. Both auto-renew their paid plans: Trust & Will’s membership yearly, LegalZoom’s attorney plans monthly or yearly. Set a reminder if you plan to cancel.

  • you want a free match with an outside attorney if your plan turns out to be complex (LegalZoom also offers attorneys from its network).

FAQ

Is Trust & Will or LegalZoom cheaper?

LegalZoom is usually cheaper: $149 for a will with powers of attorney against $199, and $399 for a basic trust against $499. For a couple’s trust with one home to transfer, the two come out almost even, because Trust & Will’s deed service costs less.

Which is better for a living trust?

Both include a pour-over will, a certificate of trust and a schedule of assets. Trust & Will includes a funding guide and offers cheaper deed transfers; LegalZoom includes a bill of transfer and, on Premium, a year of attorney calls. Pick by whether you want attorney access.

Do I have to keep paying after I buy?

No, not to keep your documents valid. Optional plans renew automatically, though: Trust & Will’s membership yearly, LegalZoom’s attorney plans monthly or yearly. Cancel them if you don’t use them.

Are their documents valid in every state?

Both offer state-specific wills in all 50 states. Trust & Will does not offer trusts in Louisiana. Documents become valid only when you sign them following your state’s rules, with witnesses or a notary as required.

Is there a free alternative?

For a will, yes: FreeWill offers a free will, health care directive and financial power of attorney, and a free trust for California residents. See the best online will makers.
