Our take

A good fit for homeowners and couples who want a guided living trust online, with a funding guide and the option to add an attorney. It costs more than do-it-yourself software, and the extras add up.

What a couple’s trust really costs

Example. A married couple buys the Trust Plan for $599, has the mobile notary and witnesses come to sign a joint trust for $200, moves their home into the trust with the deed service for $140 plus the county’s recording fee, and keeps the Essentials membership for $49. Year one comes to about $988 plus recording fees and notarizing the deed ($100 through Bundle, or a notary you arrange yourself), compared with roughly $1,500 to $4,000 for a trust drafted by an attorney.

You can do some of this yourself to save money: many banks have a notary, and your county recorder may publish deed forms. See how to fund a living trust and what a living trust costs.

How it works

  1. Answer the questionnaire about your family, assets and wishes. Payment comes after the basic questions.
  2. Get your documents as downloads, or have them printed and shipped.
  3. Sign them correctly. Trust & Will does not witness or notarize documents itself. It gives signing instructions, and you can book the mobile notary. Online notarization is offered only in Arizona, Florida, Indiana, Nevada and Utah, and not for trust documents.
  4. Fund the trust. Use the funding guide to retitle accounts, and the deed service or your county’s forms for real estate. An unfunded trust does not avoid probate.
  5. Keep it current after marriages, births, moves or big purchases.

Attorney Support: what it covers

For $299, you get a year of phone access to a licensed estate planning attorney. According to Trust & Will’s help center, the attorney can help you choose a plan and understand your documents, and answer questions about estate and gift tax, the roles you assign, beneficiary designations, general funding and signing requirements.

It does not cover tax advice for your specific situation, asset protection, marital agreements, drafting documents, reviewing documents made elsewhere, preparing or reviewing deeds, advice for other people in your plan, carrying out a plan after a death or incapacity, business matters or disputes. Trust & Will’s sales page does say the attorney can explain how to make a business or LLC trust-owned. If you need any of those, the free attorney match for complex needs, or an estate planning attorney you hire directly, is the better route. Trust & Will’s refund policy allows a full refund of Attorney Support within 14 days if you have not booked a call.

Who it fits, and who should look elsewhere

Good fit

Homeowners who want to avoid probate with a revocable living trust, couples who want one joint plan, and people who want clear funding steps without paying an attorney thousands of dollars. It also suits parents who need to name guardians.

Look elsewhere

A child with special needs, a business with three or more employees, an estate of $15 million or more or a blended family with complex dynamics call for an attorney, as Trust & Will itself says. If you only need a basic will, free or cheaper options exist; see the best online will makers.
